GvW Graf von Westphalen advises energy supplier on acquisition of a photovoltaic park

Smiling Green Energy GmbH & Co. KG (SGE) has purchased a planned open space photovoltaic park in Hessen. GvW's real property and energy law team exclusively advised SGE for the first time.

SGE is an energy supplier that specialises in the development of EEG (German Renewable Energy Act) plants, the production of green energy and the marketing of energy. The energy supplier purchases EEG plants for itself, develops such plants and operates them. It uses a combination of the various EEG plants available for this purpose.

This transaction is SGE's first investment in Germany. Confidentiality has been agreed with the vendor regarding the financial details.

The photovoltaic park is due to go into operation by the end of the first quarter of 2013. The company is currently discussing further possible investments with various co-investors .

GvW advised SGE comprehensively, in particular on real property and energy law issues. The team consisted of Dr Kurt Luka (lead partner, associate partner), Dr Sigrid Wienhues (environment and construction law, partner), Christian Esch, Wolfram Müller (both private construction law/lease law, partners) as well as Johan van der Veer (insurance, associate) and Horst Hartwig (energy law, associate). Dr Luka has been advising the owners of the energy supplier, which was established last year, for many years.
