Gives coronavirus a right to refuse performance to construction companies?

1.  As a rule, neither the pandemic nor the decrees of the federal states (Bundesländer) and municipalities should give rise to a right to refuse performance. Exceptions may apply where complete curfews have been imposed because in this cause no more services may be performed there.

2. For the rest, it depends on the individual case. Even in the case of construction measures, the minimum distance of 1.50 m between workers has to be observed. Where this is not possible or where there is a specific risk of infection, a right to refuse performance may exist.
