Nicolas Wolski, LL.M., has joined the law firm Graf von Westphalen. The 33-year old lawyer and tax advisor previously worked at Freshfields Bruckhaus Deringer for approx. four and a half years and will strengthen the firm’s tax law practice in the Frankfurt office.

A Shanghai-based team of GvW Graf von Westphalen has advised Zschimmer & Schwarz Chemie GmbH, a global supplier of high performance chemical specialties and auxiliaries headquartered in Lahnstein, Germany (“Zschimmer & Schwarz”), on the Chinese law aspects of its acquisition of Interpolymer Corporation, U.S.A., a worldwide specialist and technology leader for tailor-made specialty polymers (“Interpolymer”).

The German law firm GvW Graf von Westphalen has expanded its Shanghai office with two further associates: Lilü Zhou and De Bi will in future support the team around partners Patrick Heid and Dr. Oliver Maaz in advising German and international companies in China.

With Beijing Zhonghuan Investment Management Co., Ltd., another investor from China is investing in a German company. In the context of the acquisition of shares in EFA-S GmbH, the Chinese company has acquired a 75% majority stake from the previous shareholders. The SPA was notarized on 16 November 2015.

The law firm GvW Graf von Westphalen continues its growth strategy in the China business: The German lawyer Ming Yi has recently joined the firm’s Frankfurt office and will coordinate the activities of Chinese companies and investors in Germany together with Frankfurt-based M&A partner Dr. Marco Zessel.

The effective enforcement of EU state aid law cannot be circumvented by a binding national court judgment. This was decided by the European Court of Justice (CJEU) in its ground-breaking ruling of 11 November 2015 (C-505/14), thereby endorsing the point of view of the Federal State of North Rhine-Westphalia (NRW).

Two weeks ago, the European Court of Justice (CJEU) declared the “Safe Harbor“ decision of the EU Commission invalid (judgment of 6 October 2015, C-362/14- “Schrems”). Now, the Higher Regional Court Düsseldorf - in the first high court decision regarding the “No Spy” issue - it its decision of 21 October 2015 (VII-Verg 28/14) prohibited the awarding of the contract in the procurement procedure for the procurement of “anti-virus software for the German Federal Administration” and referred the procedure back to the procurement agency.
