Arbitration proceedings in China – Dr. Björn Etgen continues to be arbitrator for the four leading Chinese arbitration organizations

The Shanghai International Economic and Trade Arbitration Commission ("SHIAC") has again appointed Dr. Björn Etgen to the panel of international arbitrators. The Hamburg attorney, who currently is involved as an attorney for a party or an arbitrator in numerous arbitration proceedings in China, is continuing his activity for the four most important Chinese arbitration institutions and commissions. In addition to SHIAC, Dr. Etgen also handles arbitration proceedings of the recognized arbitration organizations China International Economic Arbitration Commission ("CIETAC"), Beijing Arbitration Commission /Beijing International Arbitration Center ("BAC/BIAC") and the Shenzhen Court of International Arbitration ("SCIA").

The third addition of the practice handbook by Schütze on international institutional arbitration appeared in the first quarter of this year, a comprehensive commentary on the internationally most important rules of arbitration in commercial and legal matters for the institutional arbitral tribunals in Europe, Asia and America.  This work includes a chapter on the rules of arbitration of the CIETAC, which Dr. Etgen commented together with Prof. Dr. Eckart Brödermann.

Arbitration proceedings are a frequently used method for dispute resolution in German/Chinese commerce. In the case of contracts between two Chinese parties, arbitration proceedings are only possible before Chinese arbitration institutions. This also applies in situations in which a German investor is involved through a Chinese subsidiary. You will find more about the topic of dispute resolution in China here.
