International arbitration proceedings involving the law on distribution - GvW-Partner Dr. Raimond Emde reported at the Petersberg Arbitration Seminar
A classic event among the events on arbitration is the Petersberg Arbitration Seminar. The experts in arbitration are addressing now for the 14th time disputes in the law governing distribution and antitrust law. GvW partner Dr Raimond Emde will discuss in his presentation his many years of practice in international arbitration proceedings involving the law governing distribution.
The law on commercial agents has been unified throughout Europe. The European Court of Justice had declared choice of law clauses to be invalid which excluded by contract the claim for compensation at the end of the commercial agency in the court's widely noted "Ingmar" decision. Circumventing the clause by agreeing on an exclusive jurisdiction outside Europe is also invalid according to a decision of the Federal Supreme Court of Justice (Bundesgerichtshof, "BGH"]. Dr. Raimond Emde considers the scope of choice of law and jurisdiction clauses and the effects of the case law for international arbitration.
Commercial agency law and international arbitration each make up a chapter in the Emde commentary on distribution law which was published last year in the 3rd edition at de Gruyter.
In addition to classic topics involving the law on distribution, the recognized top experts will also discuss current issues on distribution and antitrust law on the Petersberg in Königswinter. The organizer of the Petersberg Arbitration Seminar is the Beck Academy.

Federal Administrative Court: Fehmarn Belt Fixed Link may be built
The Federal Administrative Court has dismissed all six pending appeals against the planning decision on the Fehmarn Belt Fixed Link. Construction of the tunnel may therefore now also begin in Germany. Transport System Bögl: new local public passenger transport system a big success in China
The Max Bögl group of companies has developed a new local public passenger transport system. The system called “Transport System Bögl” (TSB) uses magnetic levitation, or “maglev” technology and provides a clean and cost-efficient means of transport for better mobility in inner city areas. The technology is becoming increasingly popular also in other countries: Max Bögl’s most recent export order was the sale of its TSB to China. The company’s plans include building a 3.5 km test track in Chengdu and extensive marketing activities to promote the technology in China – all through a sales partnership with a Chinese company.
