Aviation in the defence sector

GvW Graf von Westphalen has been providing comprehensive advice in the aviation sector for many years. The firm primarily advises companies in the aerospace industry and numerous national and international commercial airports. In addition, our solicitors support airlines in their legal matters. In our aviation focus area, we have brought together specialists from various fields of law with industry expertise. This enables us to provide efficient legal advice from a single source as a team.

With over 100,000 employees and annual sales in the mid double-digit billion range, the aerospace industry is an important economic factor in Germany, with the aerospace and defence industries being very closely linked in many areas.

Our team has extensive experience in legal advice and, in particular, contract drafting with regard to the entire supply chain of the aerospace industry. We are familiar with industry-specific characteristics, such as standard market quality requirements.

In recent years, one focus of our work has been advising on mergers and acquisitions (M&A) and complex restructuring. In recent years, our lawyers have advised on transactions in the aerospace sector with a total volume of several billion euros, including small, medium and large transactions, mostly with international involvement. Together with selected foreign law firms, we also regularly manage cross-border transactions and projects.

Our cross-disciplinary advice has regularly proven to be particularly helpful, for example our comprehensive expertise in foreign trade law or state aid and subsidy law.

We are particularly active in the area of preventive compliance advice, for example in setting up organisational structures and work processes in the areas of internal export control, embargoes and sanctions, as well as customs compliance and internal investigations and the corresponding communication with the relevant authorities.

Our main areas of practice:

Economic law

M&A (company acquisitions), on the buyer and seller side (including auctions)

Contract law (e.g. supply contracts with airframe manufacturers and Tier 1/2 suppliers)

Customs and foreign trade law (including investigations and compliance structures)

State aid and subsidy law
