To what must attention be paid when transferring data to the USA and other foreign countries? Data transfers to the USA can no longer be based on the so-called Safe Harbor Framework. The ECJ decided this in the fall of 2015. It is necessary to rely on alternatives since then: standard contract clauses or the privacy shield which took effect in July.
The revised Bitkom guideline on "transmission of personal data – German, EU States, foreign countries" now provides orientation and more security in the case of data transfers to the USA and other foreign countries. The work, for which the Berlin GvW partner Arnd Böken was also involved as the only attorney, provides an outlook for the new Data Protection Basic Regulation [Datenschutz-Grundverordnung] which will take effect in May 2018. The Bitkom guideline is a further important publication on the subject of data protection in 2016 in which GvW attorneys were involved. The VDMA (association of German machinery and plant construction [Verband Deutscher Maschinen- und Anlagenbau e.V.] had already published the guideline on data protection for industry 4.0 which was authorized by the GvW partner and practice group head IT and data protection Stephan Menzemer (more).

GvW Graf von Westphalen advised the transmission system operator 50Hertz on the award of a major contract for the North Sea Connector 2 offshore grid connection project. The project involves the planning, construction, installation and commissioning of a converter system comprising an offshore converter platform in the North Sea and an onshore converter station in Mecklenburg-Western Pomerania. The North Sea Connector 2 project is intended to connect offshore wind farms in the North Sea to the German electricity grid in future.
