The introduction of a whistleblower protection system is mandatory for companies with 50 or more employees and legal entities in the public sector. One of the key requirements of a whistleblower system is that the confidentiality of the identity of the whistleblower and third parties must be protected. The data must also be processed in compliance with the GDPR. GvWhistle enables you to fulfil these conditions.

  • Our price model includes a plausibility and relevance check for incoming reports as well as an initial recommendation for action
  • We also offer you a preferential hourly rate of € 290 net for five hours of legal advice per year in direct connection with reports received
  • Further activities are invoiced on the basis of the agreed hourly rates

EU Whistleblower Directive

Stakeholders of companies should be encouraged to report violations through whistleblower protection systems. This is provided for in the EU Whistleblower Directive (2019/1937), which the legislator should have transposed into German law by December 2021. Such whistleblower systems not only help to clarify violations but also serve to prevent them as an essential element of a functioning compliance management system.

The Federal Cabinet has now passed the draft bill for a German Whistleblower Protection Act. According to the current status, the law will come into force at the beginning of 2023.

Companies and legal entities in the public sector have two options for fulfilling their obligations:

They can set up an internal reporting office and appoint their own employee, who must have the necessary expertise.
Or they can organise an external reporting office. An external ombudsperson receives all reports, processes and investigates the suspected cases.
