EU Whistleblower Directive

Stakeholders of companies should be encouraged to report violations through whistleblower protection systems. This is provided for in the EU Whistleblower Directive (2019/1937), which the legislator should have transposed into German law by December 2021. Such whistleblower systems not only help to clarify violations but also serve to prevent them as an essential element of a functioning compliance management system.

The Federal Cabinet has now passed the draft bill for a German Whistleblower Protection Act. According to the current status, the law will come into force at the beginning of 2023.

Companies and legal entities in the public sector have two options for fulfilling their obligations:

They can set up an internal reporting office and appoint their own employee, who must have the necessary expertise.
Or they can organise an external reporting office. An external ombudsperson receives all reports, processes and investigates the suspected cases.
