Acquisition in the course of insolvency – ILLIES Group expands its Asian business together with GvW Graf von Westphalen
ILLIES Group has taken over EKC Machinery & Plants GmbH’s business divisions concerning the markets Indonesia and Vietnam. On 17 June, insolvency proceedings were opened against EKC Machinery & Plants GmbH, a supplier of industrial solutions including the supply of machines, equipment and know-how. GvW Graf von Westphalen advised ILLIES Group on this acquisition in the course of insolvency proceedings.
ILLIES Group with its headquarters in Hamburg offers commercial and technical solutions in the field of international trade with investment goods and has been advising its business partners on funding, insurance and transport for more than 150 years. The company has 20 locations in total –18 of which are in Asia – and focusses on business in Asia. The acquisition of EKC Machinery & Plants GmbH’s business divisions fits in with the group’s strategy to further expand its core business in Asia.
Hamburg-based partner Christian Mayer-Gießen (M&A, corporate law and trade law) and Dr Jan Tobias Hartmann (employment law) advised ILLIES Group on this transaction.
Asia is also one of the most important growth markets for many other GvW clients. With the firm’s own office in Shanghai and Istanbul and its Indian desk, the firm’s solicitors have advised numerous German medium-sized companies on their business relations with companies in China, Turkey and India. In addition to acquisitions and participations (e. g. joint ventures), supply agreements, IP topics, issues regarding customs and foreign trade law (amongst others, the “Iranian embargo”) and arbitration proceedings play a central role in the advisory business with the Far East.

The Max Bögl group of companies has developed a new local public passenger transport system. The system called “Transport System Bögl” (TSB) uses magnetic levitation, or “maglev” technology and provides a clean and cost-efficient means of transport for better mobility in inner city areas. The technology is becoming increasingly popular also in other countries: Max Bögl’s most recent export order was the sale of its TSB to China. The company’s plans include building a 3.5 km test track in Chengdu and extensive marketing activities to promote the technology in China – all through a sales partnership with a Chinese company.
