Legal advice on EmpCo

The Empowering Consumers for the Green Transition Directive (EmpCo) is part of the European Green Deal and aims to better protect consumers from misleading environmental claims. In particular, the directive expands the requirements of the EU Unfair Commercial Practices Directive (UCPD) and introduces new transparency obligations for companies. The focus is on environmental advertising, sustainability claims ("green claims"), durability statements and repairability information, among other things. In future, companies must ensure that environmental and sustainability statements are comprehensible, verifiable and not misleading. Otherwise, they face competition law warnings, regulatory action or damage to their reputation.

For manufacturers, retailers and service providers, the implementation of the EmpCo Directive means that their marketing, product and sustainability communications must be legally reviewed and adapted. This applies in particular to environmental labels, climate neutrality promises, statements on the service life of products or on reparability. Our solicitors provide comprehensive advice to companies in connection with the EmpCo Directive, from the legal assessment of sustainability statements and the adaptation of marketing strategies to the development of compliance structures in conjunction with other EU ESG regulations.
